Terms of Service

Dayforge (the "Service") is operated by Dayforge by Cris Velk ("we", "us", "our"), based in the State of Ohio, United States.

Dayforge turns spoken or typed thoughts into calendar entries, tasks, and check-ins using AI. It's designed for people who experience overwhelm, organization challenges, executive-function difficulties, and time-management struggles. It is a productivity tool, not a medical or therapeutic product.

• You must be at least 13 years old (16 in the EU) to create an account.
• One person per account. Keep your credentials safe.
• You're responsible for activity that happens under your account.
• You must give us accurate information (a real email address we can reach you at).

You agree not to:

• Abuse, disrupt, or attempt to overload the Service.
• Reverse engineer, scrape, or resell the Service.
• Attempt to circumvent AI credit or rate limits.
• Upload illegal content or content that infringes others' rights.
• Upload personal information about other people without their permission.
• Use AI output from the Service to harass, defraud, or harm anyone.
• Use automated methods to extract data, reverse engineer, scrape, or reproduce the Service.

We may suspend or terminate accounts that violate these rules.

You own 100% of your Memories and Brain Dumps — the raw text you dump, the calendar and task entries the AI creates from them, your journal history, and your check-in responses. You grant us a limited, worldwide, royalty-free license to store, transmit, and process that content only as needed to operate the Service for you — for example, syncing it across your devices and processing it through our Secure AI Gateway to structure it. We do not use your content for our own purposes, we do not sell it, and third-party LLM providers do not use it to train their general models. See our Privacy Policy for the full picture.

The Service uses AI models that can produce inaccurate, incomplete, or biased output. Do not rely on AI output for medical, legal, financial, therapeutic, or other high-stakes decisions. You are responsible for reviewing what the AI suggests before acting on it.

Dayforge routes AI requests through a third-party AI gateway. As of July 23, 2026, that provider retains request and response payloads for up to 90 days by default for operational debugging. We have submitted a formal opt-out to disable both AI training on your data and payload retention on the gateway. This section will be updated with the effective date once the opt-out is confirmed. Nothing in this notice expands the rights of any third party over your Vault data, which remains governed by our Privacy Policy.

Dayforge is a productivity tool. It is not a medical device, diagnosis, or treatment for ADHD or any other condition, and it does not replace professional medical, mental health, or therapeutic advice.

The system processes your input to generate structured schedules; each processed request consumes one AI credit.

• Free — a lifetime 30-credit trial. Optional refill top-ups can be purchased at any time.
• Basic — $11.11/month — 75 credits per month.
• Pro — $19.47/month — 200 credits per month.
• Annual — $111/year — 100 credits per month, billed annually.
• 2-Year Founding Pass — a limited early-access plan; specific credit and access terms are disclosed at purchase.
• Refills (top-ups) — Quick Refill $14.97 (100 credits) and Power Refill $34.97 (300 credits). Refill credits are added to your permanent bonus balance.

Rollover Rule. Subscription credits are valid for the full current billing period. If you cancel — or the plan otherwise ends — any unused subscription credits remain usable for a 30-day grace period after the end of that billing cycle, and then expire. Refill (top-up) credits never expire and are drained only after your subscription credits, so cancelling never forfeits credits you paid for as refills.

Payments are processed by a PCI-compliant payment processor that receives your billing details directly; we never store your card number. Prices may change with reasonable notice; changes will not apply to already-purchased 2-Year Founding Passes for the term of that pass.

Refunds are handled case-by-case. We don't offer an automatic money-back window, but if you're unhappy, email cris@velkstudio.com and we'll review. As a rough guide:

• Unused or lightly-used plan (few or no Organize runs since purchase) — we'll usually refund in full.
• Heavily-used plan (most credits already spent) — we typically can't refund, because each Organize run has already cost us real money in AI processing.
• Service failure on our end (extended downtime, a broken feature you paid for) — full refund, regardless of usage.

Refunds are issued to the original payment method within 5–10 business days. Issuing a refund cancels the subscription and revokes any remaining plan credits; separately-purchased refill credits are unaffected unless the refund specifically covers them. You can cancel any active subscription at any time from Settings. Cancellation stops future billing immediately; you keep access to your paid tier and remaining subscription credits through the end of the current billing period, plus the 30-day grace period described above. Any unused subscription credits after that window expire (refill credits excepted — those never expire).

Nothing in this section limits statutory refund or withdrawal rights you have under applicable consumer-protection law (for example, the 14-day right of withdrawal under EU law, where it applies). To exercise a statutory right, email cris@velkstudio.com.

We may suspend or terminate accounts that violate these terms or that we reasonably believe pose a risk to the Service or other users. You can delete your account any time from Settings. Doing so purges your data from our database and authentication system within 30 days. You can also email cris@velkstudio.com and we'll handle it for you. Deletion of your account does not entitle you to a refund of prepaid amounts.

The Service is provided "as is" and "as available", without warranties of any kind. We don't guarantee uninterrupted service, and we may change or discontinue features at any time.

To the fullest extent allowed by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be error-free, meet your specific needs, or that AI output will be accurate.

To the fullest extent permitted by law, our total liability arising out of or relating to the Service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD $50. We are not liable for indirect, incidental, special, or consequential damages, including lost profits, lost data, or missed appointments. Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you.

You agree to defend and hold us harmless from claims, damages, and expenses arising from your misuse of the Service, your violation of these terms, or content you upload that infringes someone else's rights.

These terms are governed by the laws of the State of Ohio, United States, without regard to its conflict-of-laws rules. Any dispute arising out of or relating to these terms or the Service will be brought exclusively in the state or federal courts located in Ohio, and you consent to the personal jurisdiction of those courts. Nothing in this section waives non-waivable consumer-protection rights you may have in your country or state of residence.

We may update these terms from time to time. If changes are material, we'll notify signed-in users. Continued use after changes take effect means you accept the updated terms.
